Architect Paul Clinton is to appeal An Bord Pleanála's decision to allow Dublin City Council to proceed with a compulsory purchase order (CPO) of the Carlton cinema site on O'Connell Street. Clinton headed the Carlton Group, which originally planned to develop the Millennium Mall retail scheme on the site. Rulings by the planning appeals board cannot usually be appealed in the courts but Clinton has issued a notice of appeal to the Supreme Court "on a point of law of exceptional public importance''. It centres on whether a planning board can confirm a (CPO) for development purposes, without requiring the acquiring body to specify the development that it proposes to carry out. Also at issue is the need to subject the proposed order to scrutiny to ascertain whether all the land is required to carry out the proposed development. Dublin City Council wants a retail, commercial and residential development on the site in accordance with the city's development plan. It said it lodged the CPO because the Carlton Group did not have the expertise nor finance to develop the site.
